The Zoning Board of Adjustments (ZBA) is a five member, quasi-judicial board that is empowered to grant variances from the Cedar Hill Zoning Code, as prescribed by the Texas Local Government Code and the Cedar Hill Zoning Code. More specifically, this board is responsible for performing the following duties and exercise the following powers:
Hear and decide appeals that allege an error in an order, requirement, decision or determination by and administrative official;
Allow the expansion or continuation of a lawfully existing nonconforming structure or a lawfully existing nonconforming use;
Authorize variances to the Zoning Code provided the variance:
is not contrary to the public interest,
is caused by a special condition
the literal enforcement of the ordinance would result in unnecessary hardship,
is in keeping with the spirit of the ordinance, and substantial just.
